What is the difference between a domain and a registered trademark?
A registered trademark grants exclusive legal rights in commerce. A domain is just a digital address. However, if a domain reproduces a trademark, it can be subject to a revocation action.
What is cybersquatting?
It is the abusive registration of domain names in order to block, resell, or take advantage of others' trademarks. It is prohibited by multiple regulations and can lead to its legal recovery.
Can I recover a domain if it is already registered?
Yes, if you can demonstrate a preferential interest in the domain name, or if it was registered abusively. This can be done before NIC Chile for .CL domains, or through the UDRP policy before WIPO for generic domains.
What evidence do I need for a revocation in NIC Chile?
It depends. For an early revocation, you must prove a preferential interest in the name, for example, by owning a trademark. For a late revocation, you must prove prior rights to the mark or name, that the domain was registered in bad faith, and that the current holder has no legitimate interest in it.
