How long does it take to register a trademark?
The entire process typically takes between 6 and 9 months, depending on whether there are oppositions or objections from INAPI.
How long does a trademark last?
Trademarks are initially valid for 10 years from the registration date and can be renewed indefinitely in 10-year terms.
What is the deadline to respond to an opposition?
Once served, you have 30 administrative business days to respond. This excludes holidays, Sundays, and Saturdays.
What is the Nice classification?
It’s an international system that categorizes goods and services into classes. You must select the appropriate class when registering your trademark.
What happens if I don’t use my trademark?
If you don’t use it for five consecutive years, any third party may request its cancellation due to non-use.
What should I do if someone is using my trademark?
If someone is using your trademark—or a confusingly similar one—you may take various legal actions. Industrial property law, unfair competition law, and consumer protection laws can all be applied in these cases.
